Terms of Service
1. Booking Confirmation
A Program booking is confirmed upon receipt of either a 40% non-refundable booking fee or acceptance of an invoice or quote, whichever occurs first. Acceptance confirms the program details discussed (date, location, participant numbers, program type, estimated cost) and agreement to these Terms of Service. Program scope or cost may be re-estimated if any details change after booking.
2. Payment Terms
You may choose from two payment options:
- Option 1: Pay a 40% non-refundable deposit upfront to confirm the date, with the balance invoiced 14 days before the Program date.
- Option 2: Pay the full invoice amount within 7 days of issue.
Failure to pay the balance by the due date will be treated as a cancellation and will be subject to cancellation fees.
3. Wet Weather Policy
Be Challenged monitors weather in the lead-up to outdoor events. Based on forecasted conditions:
- 1–5mm rain: Proceed outdoors with ponchos provided.
- 5–10mm rain: Shift to an indoor activity (e.g. Chain Reaction, Quickfire). Additional venue hire may apply.
- 10mm+ rain or 35°C+ heat: Indoor program will be required.
- Extreme conditions: Event postponement may be offered, subject to supplier cancellation fees and availability.
4. Program Rescheduling and Cancellation Policy
Cancellation Schedule
If the client cancels the event after confirming the booking:
- 30+ days before the event: Deposit retained; balance refunded.
- 15–30 days before the event: 50% of the total event fee charged.
- 14 days or less before the event: 100% of the total event fee charged.
In all cases, 100% of any external supplier costs (e.g. venue hire, catering, transfers) where Be Challenged is liable on behalf of the client, will also be charged.
All cancellations must be submitted in writing.
Rescheduling Policy
- One complimentary date change is permitted if requested 30+ days before the program and rescheduled within 12 months. Any further date changes will incur a $250 fee.
- Requests to reschedule within 30 days of the program may be treated as a cancellation and charged accordingly.
Mitigation Efforts
In the event of a cancellation or rescheduling request, Be Challenged will make all reasonable efforts to rebook a new date. If successful, the client’s cancellation charges may be reduced, at Be Challenged’s discretion.
5. Changes to Participant Numbers
Final participant numbers must be confirmed at least 14 days prior to the event.
- Reductions after this point will not result in cost savings.
- Increases must be advised as early as possible and will incur additional charges.
6. Client Responsibilities
The client is responsible for the conduct of all participants and is liable for:
- Any damage to Be Challenged equipment beyond fair wear and tear.
- Compliance with all laws and venue rules during the event.
- Venue hire and permits (unless arranged by Be Challenged).
7. Insurance
Be Challenged holds Public Liability Insurance up to $20 million, covering the facilitation of our programs. This does not extend to transport to/from the venue or the use of registered vehicles.
8. Media Use Consent
Unless otherwise agreed in writing, the client grants Be Challenged the right to use photos, videos, or content captured during the event for marketing and promotional purposes.
9. Liability for Damages
The client is financially responsible for any damage to Be Challenged equipment or third-party property arising from participant behaviour, beyond normal use. This includes equipment hired by or through Be Challenged.
10. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be resolved under the jurisdiction of Australian courts.
